A new sex club for swingers, fetish lovers and the LGBT+ community has won permission to open despite an alleged serious sexual assault and concerns over the owner’s drug convictions.

Dare To, on an industrial estate in St Philips, has been described by a customer on Facebook as a “Tardis” because of its 10 “playrooms themed to cater for various needs” and a basement dungeon, where couples and groups have or watch others having sex.

Bristol City Council’s licensing sub-committee heard the private members’ club, at a former Victorian pub in Alfred Street, had been operating for the last two-and-a-half years under temporary event notices (TENs) by Dare To Club Ltd director Cheryl Brice.

 

At a hearing in February, police objected to an all-night dance party at the venue because of Ms Brice’s string of convictions, including attempting to smuggle class-A drugs into prison.

Councillors allowed the event to go-ahead after being told it was “essential” for Bristol’s transgender community and had a “zero tolerance on drugs”.

They have now granted a premises licence at a meeting on Thursday (November 14) after hearing Ms Brice, 40, was granted a personal licence by South Gloucestershire Council last month and now has a “good working relationship with police”.

Her solicitor, Piers Warne, told the panel: “It’s important to know it was granted very recently because part of applying for a personal licence is that there is a DBS check and police can object if they feel that person should not hold a personal licence.”

‘Safe and inclusive place’

He said Ms Brice’s application for a premises licence at Dare To was endorsed by groups including Trans Pride South West and Save Bristol’s Nightlife because it provided a “safe and inclusive place for marginalised groups who don’t naturally find a home in more mainstream venues”.

But he said: “There is an allegation of a serious sexual assault at the premises made in the police representation.

“The woman who made the allegation is known to Cheryl. The woman still attends the premises, so she obviously does not have a concern about the way the premises are managed or the way it managed her incident.”

Councillors excluded the press and public to hear representations from Avon & Somerset Constabulary behind closed doors.

When the meeting reopened, sub-committee chairman Cllr Fi Hance said they were granting the premises licence application to serve alcohol from midday to 6am daily, subject to conditions.

Fellow Green Cllr Paula O’Rourke said: “We were reassured there seems to be a good working relationship with the police.”

But the panel’s other member Conservative Cllr Richard Eddy said: “The decision today was a majority vote.

“I voted against on the grounds I felt the applicant’s previous police record made her unsuitable as a designated premises supervisor.”

Members set a capacity of 160 people inside the club following confusion over a recent risk assessment, published just two days earlier, which Avon Fire & Rescue Service had not had time to appraise.

Mr Warne said: “Cheryl has operated under TENs since April 2017, always with the intention to come back to committee to apply for a licence.

“There have been no complaints about any of these TENs apart from a daytime event in July 2018 that overran by 18 minutes.”

The club appeared on Channel 5 documentary The Sex Business last month in an episode called Spank Me Harder.

Senior licensing officer Abigail Holman told Thursday’s hearing: “Some activities are done by way of a members’ club and that would be not necessarily considered regulated entertainment.”

Club rules

On the club’s website, its terms & conditions for customers say: “Easy on the alcohol – a drunk is not an attractive swinging partner, it can impair your performance and we may not be able to fully consent in a play situation.

“No sex in the hot tub. This is not only unhygienic it is also a health risk and irresponsible

“Please do not spoil the use of the hot tub for others, there are plenty of rooms to play in.

“Please clean up your mess after using a playroom. It is not very nice if a person goes into a room that has not been cleaned after other persons’ use.

“Open playroom doors – an invitation to others to join them in the room to watch, wait till you are asked to join in.

 

“Closed playroom doors – please respect the privacy of people in the room, ie, no speaking loudly outside the room..

“Don’t stand in the playrooms and chat, this is very off-putting for everyone and disrespectful – it’s OK to watch, or join in if asked. If you want to talk to someone please go to the lounge or bar areas.”

Events in November include Femdom Switch Spanking Party, Fetish Sole Desires and Over-30s Couples Only Wife Swap.

As reported in February, Ms Brice was sentenced to 18 months behind bars in 2012 for possessing class-A drugs with intent to supply.

 

Bristol Crown Court heard she agreed to store a safe containing more than £20,000 worth of drugs for a mystery dealer.

Police discovered a metal safe in a wardrobe at her home with £19,360 worth of cocaine, £510 worth of amphetamine and a small amount of cannabis inside it.

Then 33, she pleaded guilty to possessing the class-A drugs with intent to supply as well as possessing a class-B drug.

She also has convictions for drink-driving, driving after taking drugs and, in August last year, driving while disqualified, for which she was recalled to prison and released on January 10 under a curfew.
